Yolo County District Attorney Jeff Reisig and the ACLU mixed it up today in the 3rd District Court of Appeals.
You can read the article from the Sacramento Bee here.
It doesn't matter if you agree with Reisig or not you have to love the fact that he is in the court room himself....making it happen.
From what I have read about this case I completely agree that the plaintiffs do not have standing since they are not impacted by the injunction. Unless the plaintiffs are willing to admit they are gang members they need to wait for someone that is willing to do that.
This would be like me seeking punative damages in a class action suit by long haired, Peace and Freedom party members, vegetarians from Davis. |

Jeff made it to the evening news on Channel 10 also!
I am sure they gave the notice to the only Broderick Boy that could read. LOL!

I think that a non-gang member would have standing to sue, especially if they could prove that the gang injunction was erroniously applied to them. Such a claim would prove the language of the injunction vague and/or its enforcement capricious.

I predict that the current court will rule against the injuction (2-1); the county will appeal to state supreme court and it will refuse to hear the case.
